A child under the age of 15 can consent to a sexual relationship with an older person if that person is no more than 4 years older.

For instance, Sexual Assault, C.R.S. 18-3-402, charges can be filed if sexual intrusion or sexual penetration occurs on a victim less than 15 years of age when the actor is at least four years older than the victim and isn't the victim's spouse. Sexual Assault charges can also be filed when sexual intrusion or sexual penetration occurs on a victim 15 or 16 years old when the actor is at least ten years older and isn't the victim's spouse.

Sexual Assault on a Child by One in a Position of Trust Adams County Attorney | Children Can't Give Consent When Actor in Position of Trust

In Adams County and across Colorado, children cannot give sexual consent if a person is in a position of trust with respect to the child and the child is less than 18 years of age. If a sexual relationship occurs between a person in a position of trust and the child is less than 18 years old, that person can face charges of Sexual Assault on a Child by One in a Position of Trust, C.R.S. 18-3-405.3. Sexual Assault on a Child charges, C.R.S. 18-3-405, can also occur if sexual contact occurs between a victim who is less than 15 years of age and the actor is at least four years older than the victim.
