Posting a Private Image for Harassment in Denver: Man Accused of Posting Nude Images of Woman on Facebook

According to the news, a 32-year-old man was accused of posting nude pictures of a woman onto her Facebook page. He allegedly posted different pictures of her onto her Facebook and sent them to over 12 of her friends, including her mom. The woman had been talking with the man prior to the incident, which is when she sent him the pictures. The man noticed she had been talking with another man after gaining access to her Facebook account, and became angry. That's when he decided to post the nude pictures of the woman onto her Facebook. He then pretended to be the alleged victim and made sexual comments directly to those he sent the pictures to. In Denver and Arapahoe County, the man could be charged with Posting a Private Image for Harassment.

Posting a Private Image for Harassment in Douglas County

The definition of Posting a Private Image for Harassment, C.R.S. 18-7-107, in Douglas and Adams County is:

(1)(a) An actor who is eighteen years of age or older commits the offense of posting a private image for harassment if he or she posts or distributes through the use of social media or any web site any photograph, video, or other image displaying the private intimate parts of an identified or identifiable person eighteen years of age or older:

(I) With the intent to harass the depicted person and inflict serious emotional distress upon the depicted person;

(II) (A) Without the depicted person's consent; or

(B) When the actor knew or should have known that the depicted person had a reasonable expectation that the image would remain private; and

(III) The conduct results in serious emotional distress of the depicted person.

Since the 32-year-old man is accused of posting or distributing nude pictures of a woman over social media without her consent / when she expected the photos to be private, he could be charged with Posting a Private Image for Harassment. A Douglas County prosecutor would have to prove the actions caused the woman serious emotional distress.  In Adams, Douglas County and across Colorado, Posting a Private Image for Harassment is a class 1 misdemeanor.
