Sexual Exploitation of a Child – Johnstown, Colorado

Sexual Exploitation of a Child charges resulted from the combined efforts of the Colorado Springs police, Johnstown police, and the United States Department of Homeland Security, Immigration and Customs Enforcement.  The charges of Sexual Exploitation of a Child brought against the Johnstown man in Weld County are serious sex offenses. According to the Greeley Tribune, the Johnstown resident was arrested for allegedly sending and downloading photographs on a peer-to-peer network. The photographs in question are of nude girls between the ages of 7 and 12 years old.

The resident's illegal activity was first noticed by a Colorado Springs detective who monitors peer-to-peer networks for child pornography activity in Colorado and across the country. When using peer-to-peer networks for downloading any content, it is important to exercise caution because sometimes items will be packaged together, and one may not know what is on his or her computer until it is too late.

This Johnstown man incriminated himself when talking with the police. He admitted to downloading some of the images, claiming they were of girls 12 and older. He is currently being held in Weld County Jail on two counts of Sexual Exploitation of a Child. If he possesses less than 20 items that are considered sexually explicative, no videos, video tapes, or motion pictures, and this is his first offense, he will only be potentially convicted of two class 6 felonies. The sentencing for the class-6 felonies can run anywhere from one year to three years in the Colorado Department of Corrections. Section 18-6-403, C.R.S.

One common defense for charges of Sexual Exploitation of a Child is if the photos do not depict any real or simulated sexual gratification by any of the victims, no erotic fondling is taking place, and nothing depicting any form of a sexual act is occurring.
