Prostitution and Roommates with Benefits: A Very Fine Line in Denver

According to an undercover news story, men in Denver, Adams and Jefferson County are posting on Craigslist, offering “free rent” for young women, or “roommates with benefits.” These postings are walking a very fine legal line. These men could face charges related to Prostitution – C.R.S. 18-7-20, Solicitation of a Prostitute – C.R.S. 18-7-202, or ultimately – Pimping – C.R.S. 18-7-206. Something of Value in Exchange for Sex = Prostitution

Many of the ads were worded with vague terms and suggestions and didn't mention the free rent was in exchange for sex, such as “free rent for a female.” Others, however, were explicit, saying they expected sex one to three times per week in exchange for the free room. Some mentioned they wanted the women to sleep in their bed, and one specifically mentioned in an interview that the arrangement would require sex. These men could face charges related to prostitution in Arapahoe, Larimer and Douglas County. Prostitution is charged whenever something of value (such as rent) is traded for sexual acts. Solicitation of a prostitute is committed when someone requests the services of a prostitute with the intention of engaging in sexual acts.

“Roommates with Benefits” Craigslist Ads Create a Dangerous Situation

Let's say a young woman responds to the posting on Craigslist for free rent. This situation could quickly become dangerous. In this arrangement, the woman's rent is dependent on committing sexual acts, which is both dangerous and degrading. These types of circumstances often lead to women being kidnapped into the sex trade, raped, or even killed. Even if the man posting the ad was harmless and simply lonely, he could be charged with Pimping. Pimping is committed whenever a person “knowingly…is supported…by money or other thing of value” which is “earned…through prostitution.” Pimping is a class 3 felony in Boulder, Clear Creek and Gilpin County, which could result in a prison sentence for up to 12 years. In every way, this type of situation is dangerous, both legally and socially, to both men and women.
