Denver Sexual Exploitation of a Child Attorney | Douglas County Teacher Charged with a Child Pornography Crime

Possessing, distributing, and creating child pornography are all charged under the same crime of Sexual Exploitation of a Child in Denver and Douglas County. A teacher was recently arrested and charged with Sexual Exploitation of Children for ‘using his cell phone inappropriately.' While no further details were shared regarding the allegations, it likely involved some of the teacher's students, as a letter was sent home stating that some students were impacted.

Arapahoe and Adams County Sexual Exploitation of Children Definition

The Adams and Arapahoe County, Colorado law definition of Sexual Exploitation of a Child – C.R.S. 18-6-403 – is:

(3) A person commits sexual exploitation of a child if, for any purpose, he or she knowingly:

(a) Causes, induces, entices, or permits a child to engage in, or be used for, any explicit sexual conduct for the making of any sexually exploitative material; or

(b) Prepares, arranges for, publishes, including but not limited to publishing through digital or electronic means, produces, promotes, makes, sells, finances, offers, exhibits, advertises, deals in, or distributes, including but not limited to distributing through digital or electronic means, any sexually exploitative material; or

(b.5) Possesses or controls any sexually exploitative material for any purpose; or

(c) Possesses with the intent to deal in, sell, or distribute, including but not limited to distributing through digital or electronic means, any sexually exploitative material; or

(d) Causes, induces, entices, or permits a child to engage in, or be used for, any explicit sexual conduct for the purpose of producing a performance.

Based on the teacher's access to children, the fact that students were impacted, and the allegations specifically related to his cell phone, it could be surmised that the teacher used his cell phone to record or take inappropriate pictures of students. If that were the case, then likely he would be charged for a violation of part (a).

Sentence for Sexual Exploitation of a Child in Jefferson County

A charge under part (a) of the Sexual Exploitation of a Child statute in Jefferson County is a class 3 felony, punishable by 4 to 12 years in the Colorado Department of Corrections and up to $750,000 in fines.  It is also considered a sex offense and will require sex offender registration.
