A Colorado man is facing Invasion of Privacy for Sexual Gratification charges. Read more in our blog.
Our culture is obsessed with sex. You don't have to look far to prove this fact. Just a trip to the grocery store in Denver, Arapahoe, and Douglas County and a glance at the magazine rack proves my point. Or flip on the television and try to watch an ad that doesn't include some reference to sex. It is overwhelming our culture. So, it shouldn't surprise us when people engage in sexually questionable behavior, right? Wrong. Our society is extremely heavy-handed when it comes to sex offenders and sex crimes, despite our frequent advertisements for illicit sex. Take, for example, a recent case in Colorado.

Sergeant Faces Invasion of Privacy for Sexual Gratification Charges

A sergeant in Colorado is facing a court martial. According to reports, he secretly took a video inside a restroom of an unclothed woman, and showed it later to a co-worker. In Colorado, this is called Invasion of Privacy for Sexual Gratification – C.R.S. 18-3-405.6. This crime is usually charged as a misdemeanor, but it is a sex offense in Adams, Larimer, and Jefferson County. This means that the person convicted will be required to undergo sex offender treatment overseen by the harsh Colorado Sex Offender Management Board (SOMB). They must also register as a sex offender and live a secluded life under those regulations.

In a Sex-Obsessed Culture, We Need to Look to the Heart

As a Christian criminal defense attorney, I am struck by the futility of imprisoning people who act out of a predictable response to our culture. We live in a world where sex tapes make you famous. Paris Hilton and Kim Kardashian have proved this fact. The media is saturated with sex – there are magazine articles on how to have the best sex, and sexually explicit movies on TV. This fuels the desire and curiosity of people to engage in risky sexual behavior like filming secret videos in a restroom. While I believe that kind of behavior is inappropriate, the response to throw them in jail and toss them in treatment isn't necessarily the best option. The SOMB has a no-cure philosophy towards sex offenders. They believe offenders are dangerous and suffer from a behavioral disorder which makes them unable to be treated. As a Christian, I don't agree with this belief. We are all sinners. Treating someone as an outcast because they made a mistake isn't the answer. But, I know true redemption can only come from Jesus Christ and his love. This is why I felt called to become a criminal defense lawyer – to help people in their greatest time of need and point them to Christ, the only true savior and relief from their destructive behavior.
