A while ago, a Colorado Springs therapist faced charges of sexual assault for having sex with one of his group therapy patients. Apparently, a woman had been seeing the therapist and began a flirtatious relationship with him before starting a sexual relationship. The woman said she had sex with the therapist on multiple occasions, and another one of the therapist's patients was also involved in a sexual encounter. However, there was no mention of the sexual relationship being coerced or forced. Unfortunately for the therapist, this does not matter. The definition of Sexual Assault on a Client by a Psychotherapist, C.R.S 18-3-405.5 in El Paso, Jefferson County and across Colorado is:

Any actor who knowingly inflicts sexual penetration or sexual intrusion on a victim commits aggravated sexual assault on a client if:

  • The actor is a psychotherapist and the victim is a client of the psychotherapist; or
  • The actor is a psychotherapist and the victim is a client and the sexual penetration or intrusion occurred by means of therapeutic deception.
  • Aggravated sexual assault on a client is a class 4 felony.

Any actor who knowingly subjects a victim to any sexual contact commits sexual assault on a client if:

  • The actor is a psychotherapist and the victim is a client of the psychotherapist; or
  • The actor is a psychotherapist and the victim is a client and the sexual contact occurred by means of therapeutic deception.
  • Sexual assault on a client is a class 1 misdemeanor.

If the two women were involved in simply sexual contact with their therapist, this man will face charges of Sexual Assault on a Client by a Psychotherapist.
