Douglas County Sexual Assault Attorney: Man Released After Sex Assault Conviction

I'm not sure if you heard, but an appeals court recently overturned a conviction of a man who spent 28 years in prison for rape and assault. In 1987, the defendant was accused by his neighbor of raping her and beating her. The victim alleged she had a dream the defendant was the one who raped / beat her. After years passed, another man admitted to committing the crime. Around then, the defendant collected enough money to conduct DNA testing on the evidence. Blood testing of items from the crime scene matched the blood type of the man who confessed to committing the crime. However, police “accidentally” destroyed the evidence before it was analyzed and the defendant wasn't granted a new trial. In 2013, however, the man who admitted to committing the crime admitted to investigators he committed the crime. He also admitted to committing the crime in a recent hearing in the summer of 2015. The blood tests and the man's confession were some of the reasons a new trial was ordered, as well as for the defendant to be released from custody. The judge who ordered the new trial said new and old evidence from the case would likely return a verdict of acquittal in favor of the defendant.

Aurora Sexual Assault Cases with No Evidence Still Go To Trial

As you can see from this news story, there wasn't any evidence to originally convict the defendant of Sexual Assault other than the victim's word, who concluded the defendant was her attacker from a dream. There are numerous Aurora and Arapahoe County Sexual Assault cases where innocent people are sent to prison because of exaggerated or untrue stories. True justice is believing someone is innocent until proven guilty, so why doesn't our Colorado criminal justice system operate under that belief?
