A man and woman were making national news headlines for a Public Indecency case after being caught having oral sex on an plane. The two were strangers before getting on the plane, but apparently hit it off, because she performed oral sex on him while sitting in their seats – in plain view of the other passengers. While this case is currently under federal jurisdiction, if something similar had occurred in a Castle Rock or Highlands Ranch park or other public area, Colorado's Public Indecency charge would apply.

Denver Public Indecency Lawyer: Definition of Public Indecency on a Plane in Arapahoe County

The Denver and Arapahoe County, Colorado law definition of Public Indecency – C.R.S. 18-7-301 – is:

(1) Any person who performs any of the following in a public place or where the conduct may reasonably be expected to be viewed by members of the public commits public indecency:

(a) An act of sexual intercourse; or

(c) A lewd exposure of an intimate part as defined by section 18-3-401 (2) of the body, not including the genitals, done with intent to arouse or to satisfy the sexual desire of any person; or

(d) A lewd fondling or caress of the body of another person; or

(e) A knowing exposure of the person's genitals to the view of a person under circumstances in which such conduct is likely to cause affront or alarm to the other person.

An act of sexual intercourse includes oral sex, as defined by Colorado law.

Sentence for Public Indecency in Jefferson and Adams County

As a class 1 petty offense in Adams and Jefferson County, Public Indecency is punishable by up to 6 months in the Adams County Jail and a fine of $500. However, it can be charged as a class 1 misdemeanor under certain circumstances. However, for the couple above, they would be looking at a petty offense charges under the Colorado statute. Luckily, a first time conviction for petty offense Public Indecency does not require sex offender registration, however a second or subsequent offense might.
