
If you've watched the television series, 19 Kids and Counting, you've likely heard about the “Duggars scandal”. A while ago, one of the sons was accused of inappropriate sexual contact. Apparently, he touched his sisters' genitals while they were sleeping. The son was near 14 years of age when this happened. Of course, this came as a shock to viewers of the show and people were quick to pass judgment. In Adams and Jefferson County, his actions would be seen as Incest. Incest, C.R.S. 18-6-302 is charged in many ways in Douglas County and across Colorado. In the Duggars' case, one of the Duggars could face charges of Incest because he subjected his sisters to sexual contact. “Sexual contact” is an important part of this statute because of its definition. Sexual contact, C.R.S. 18-3-401, includes the knowing touching of someone's intimate parts, or the knowing touching of the clothing covering someone's intimate parts, for the purposes of sexual arousal, gratification or abuse. Either the actor or the victim can do the touching. While the son not only admitted to the sexual contact against his sisters, he also seemed genuinely sorry for it. He said he hurt his family and agreed to go through counseling. Perhaps the most important piece of the story is that he was still a kid when the sexual contact occurred. Despite all of this, society and the media across Colorado are still merciless.
