A 21 year old man has been charged with Internet Luring of a Child and other sex crimes after talking to a 13 year old online and meeting up for sexual contact.

A Colorado Springs, El Paso County man was recently arrested and charged with Internet Luring of a Child, Sexual Exploitation of a Child, and Sexual Assault on a Child. According to the news report, the man had initially contacted the minor online and the two must have met in person in order for the Sexual Assault on the Child charges to apply. While not many details have been provided, we have seen similar cases where an Adams County or Denver man meets a young teen in a chat room, asks for pictures that are sexual in nature, and then sets up a time to meet in person. Commonly, these types of cases are sting operations, where Denver Police are posing as young teenagers, communicating with men online and agreeing to meet with them in order to make an arrest.

The Jefferson County, Colorado law definition of Internet Luring of a Child – C.R.S. 18-3-306 – is:

An actor commits internet luring of a child if the actor knowingly communicates over a computer or computer network, telephone network, or data network or by a text message or instant message to a person who the actor knows or believes to be under fifteen years of age and, in that communication describes explicit sexual conduct in connection with that description, makes a statement persuading or inviting the person to meet the actor for any purpose, and the actor is more than four years older than the person or than the age the actor believes the person to be.

In Douglas County and elsewhere, because the 21-year-old man communicated online with the 13-year-old, and through the communications agreed to meet in person, the man is facing this charge.

Sentence / Punishment for Internet Luring of a Child in Arapahoe County

Internet Luring of a Child can be charged as a class 5 felony or class 4 felony in Arapahoe County.  Based on the fact that the man was also charged with Sexual Assault on a Child, he would likely be charged with the class 4 felony – meeting for the purpose of engaging in sexual contact. This class 4 felony sexual offense is punishable by an indeterminate sentence to the Colorado Department of Corrections.
