According to the news, a man is accused of videotaping children changing clothes at a water amusement park. He is also accused of editing the footage into movies he titled “Water Park Fun” and sharing the movies online. In Denver, Las Animas County and everywhere else in Colorado, this man could be charged with Sexual Exploitation of a Child.

Sexual Exploitation of a Child in Douglas County – Charged When Sharing Sexually Exploitative Material

Sexual Exploitation of a Child is a complicated sexual offense in Douglas County, Adams County and across Colorado. It can be charged under many different circumstances. As it pertains to the news story, one way Sexual Exploitation of a Child, C.R.S. 18-6-403(3)(b), can be charged is if someone:

“Prepares, arranges for, publishes, including but not limited to publishing through digital or electronic means, produces, promotes, makes, sells, finances, offers, exhibits, advertises, deals in, or distributes, including but not limited to distributing through digital or electronic means, any sexually exploitative material.”

Sexually exploitative material is a lengthy definition, but one of the things it includes is videos depicting a child engaged in, participating in, or being used for explicit sexual conduct. Since the man in the news story allegedly filmed children changing (which could be considered explicit sexual conduct) and sharing the videos online, he could be charged with Sexual Exploitation of a Child.

In Jefferson County, Arapahoe County and every other county in Colorado, sharing sexually exploitative material (under C.R.S. 18-6-403(3)(b)) is a class 3 felony.
