Man Accused of Internet Sexual Exploitation for Asking for Nude Images of Children

According to the news, a 47-year-old man was accused of sexually exploiting children after his home was searched. He was accused of sending multiple sexual messages online to a girl who was 9 years of age. After a search of his home was done, nearly 70 pornographic videos were found. He later admitted to investigators that he talked with 10 and 14-year-old girls online and later convinced them to send him nude images. He said he met them through online games and over YouTube. In Denver and Adams County, this man could be charged with Internet Sexual Exploitation of a Child.

Attorney in Douglas County for Internet Sexual Exploitation of a Child

As it pertains to this news story, Internet Sexual Exploitation of a Child, C.R.S. 18-3-405.4, is charged in Douglas and Arapahoe County whenever an actor importunes, invites, or entices someone they know or believe is under fifteen years old and at least four years younger than them online or over the phone to:

  • Expose or touch their own intimate parts or another's intimate parts while talking with the actor online or over the phone;
  • Observe the actor's intimate parts over the computer or over the phone.

Since the man allegedly asked young girls (under 15 years old and at least four years younger than him) to send nude images online, it would be considered Internet Sexual Exploitation of a Child.

Jefferson County Internet Sexual Exploitation and Indecent Exposure

What's interesting to me is the way Internet Sexual Exploitation of a Child in Jefferson County and across Colorado is charged. For example, a similar crime (Indecent Exposure, C.R.S. 18-7-302), is charged when a person exposes their genitals to the view of any person, which would likely cause alarm, and with intent to arouse or satisfy the sexual desire of any person. Any person obviously includes children. Yet, Internet Sexual Exploitation of a Child is charged more harshly than Indecent Exposure. If you send a nude image or video to a child online or over the phone, it will be considered a class 4 felony. But, if you expose your genitals to a child in person, it is a class 1 misdemeanor. These are the kinds of things that demonstrate the flaws in the way our laws are written and why our attorneys fight so hard for justice. An experienced Internet Sexual Exploitation of a Child lawyer is vital if you've been charged with Internet Sexual Exploitation of a Child in Boulder, Jefferson County or anywhere else in Colorado. A knowledgeable attorney will fight against exaggerated or unreasonable charges against you.
