Sexual Assault Charges Among Kids on the Rise in Colorado | SAOC in CO

Sexual Assault on a Child (SAOC) charges are on the rise in Colorado.
Children are smart. They watch what happens around them, and they behave in manipulative ways. With the increase in media in our culture, sex, lies, intrigue and violence are commonplace and acceptable. So, when kids in Denver, Arapahoe and Larimer County want something – they often use allegations of inappropriate sexual behavior to get what they want. They know the police always believe the child “victim” in a sexual assault on a child case. They know the prosecutors will blindly fight hard for their “victims”. Most people can't imagine their sweet middle school child lying about something so terrible. As criminal defense attorneys, we see these kinds of cases often in Aurora, Thornton and Cherry Creek. Children are more sophisticated than we give them credit for.

No Morals = Manipulative Lies

There is no teaching about right and wrong in our schools. In fact, children in schools across America are taught to do what they feel like doing. They are taught their feelings and desires are top priority. Children today have a thorough understanding of the evils of the world, but lack a moral compass. This is a dangerous combination when Colorado's laws regarding sex crimes are considered. No physical evidence is needed for a conviction – only an accusation is required.  When coupled with utter selfishness, the laws regarding Sexual Assault on a Child (SAOC) send many innocent men and women to prison.

SAOC = No Physical Evidence Needed for a Conviction

Colorado has some of the harshest laws regarding sex crimes in the country. All it takes for a person to be convicted of SAOC is an accusation from a child. We have seen cases where a girl or a boy wanted revenge after a divorce, or the desire to remove their new, unwanted step-dad from their lives. Whatever the reasoning behind such selfish behavior, even an unfounded allegation has the ability to destroy a person's future and life.

Sexual Assault Conviction = Harsh Consequences

No one wants to “take a chance” and let a possible sex offender loose in Douglas, Jefferson and Adams County. So, the government blindly sides with the alleged victim in a SAOC case, simply to avoid scandal. The consequences to a conviction are enormous and life-altering. This crime is subject to Indeterminate Sentencing, which means a person could spend the rest of their life in prison. It also requires a person undergo sex offender treatment overseen by the Sex Offender Management Board, and register as a sex offender.
