Sexual Assault on a Child (CRS 18-3-405) Charges Dismissed Man Treated Like Convicted

Mere accusations of Sexual Assault (CRS 18-3-402), Enticement of a Child (CRS 18-3-305), or Internet Luring of a Child (CRS 18-3-306) may convict a person in the eyes of the public before the defendant even pleads to the charges. A man in Fort Collins was accused of four counts of Sexual Assault on a Child (CRS 18-3-405). The man states that the accusations came from a bitter divorce and fight over parental custody. The Larimer District Attorney dismissed the case completely, but the man had already lost his job and was forced to relocate because of the allegations. False accusations of sexual assault may ruin lives of people living in Denver, Arapahoe, or Jefferson County.

This man has not been able to get his record sealed and employers have full access to the four counts of Sexual Assault on a Child. Even though the case is dismissed, employers still feel that the accusations alone are enough to put a question in their minds about this man's character. The man also stated that he felt hostility in his old neighborhood and was forced to move, even though he never pleaded or was found guilty of any crime.

Criminal defense lawyers and county prosecutors know the seriousness of sexual assault charges. The District Attorney will work hard to prove the charges at all costs, but experienced defense attorneys know how hard it can be to survive charges of sexual assault, let alone how to recover after a person has been convicted.

This man is now involved in lengthy battle to seal the records that contain the charges so they are not available to future employers. But, community attention surrounding this crime is elevated and so far he has not been successful. Closure of records for charges are another reason why you need an experienced criminal defense on your side early if you are accused of sexual assault.
