In one recent news story, a Correctional Youth Security Officer at the Gilliam Youth Detention Center in Denver is accused of sexually assaulting two underage females in custody. The youth security officer is accused of having sexual contact with two girls on multiple occasions in April, November and December of 2016. In Denver, the youth security officer would likely face charges of Sexual Conduct in a Correctional Institution and Sexual Assault on a Child by One in a Position of Trust.

“An actor knowingly subjects another not his or her spouse to any sexual contact if the victim is a child less than eighteen years of age and the actor committing the offense is one in a position of trust with respect to the victim.”

If the female victims were under the age of eighteen, the youth security officer would also face charges of Sexual Assault on a Child by One in a Position of Trust since he subjected them to sexual contact. The “position of trust” label is broad and can apply to anyone who is concerned with the rights, duties or responsibilities of a child at the time of an unlawful act. In Colorado, Sexual Assault on a Child by One in a Position of Trust can be either a class 3 felony or class 4 felony. It is also subject to Colorado's indeterminate prison sentencing laws, meaning the convicted person could be sentenced for an indeterminate period of time.
