Unlawful Sexual Contact & Reading Women – C.R.S. 18-3-404

Men, by now you should know it is almost impossible to read a woman.  So, you'd better be sure sexual contact with her is ok.  Unlawful Sexual Contact (C.R.S. 18-3-404), in Adams, Jefferson, and Denver County is defined as “knowingly subjecting a victim to any sexual contact IF the actor knows that the victim does not consent”.  This sexual contact involves contact with a woman's breast, pubic area or buttocks.  When allegations are made by her that she did not consent to your touch, you will likely be arrested and charged with a sexual offense.

Beyond knowing that she consents to the sexual contact, you need to read her well enough to know that she is not the type of woman who will lie afterwards about the sexual contact.  I often have cases in Weld, Douglas, Larimer and Arapahoe County where a woman consents to sexual contact, and then after, when discovery of the sexual encounter is made by others, she alleges she did not consent.  She has a boyfriend who is upset or she faces family members finding out.  She tries to save face by alleging she was too drunk to consent and that she was taken advantage of.  In the more serious of cases, she alleges she was raped without concern that it may cost a man his life.  All this woman cares about is saving face.

You need to find a woman that you can love and be loved by.  A one night encounter may seem wonderful and make you feel like James Bond, but when you awake in the county jail, you will realize this feeling is short lived.  A long-term, committed relationship offers stability, as you know someone deeply and are known deeply.  Sure, these relationships are not free.  You can't go out and have sex with new women every week and it is difficult work being in a relationship.  You are a messed up person and so is she.  It takes a lot of time to overcome our brokenness and achieve the oneness we were destined for.

Sexual offense convictions involving crimes like Unlawful Sexual Contact or Sexual Assault (CRS 18-3-402) will result in government control over every part of your life under the evil (I truly mean that word) practices of the Colorado Sex Offender Management Board (SOMB).  Within that organization are people who will control every component of your life.  They will destroy your career without concern.  They will kill your relationship with your kids for no good reason.  They will harm your marriage for no reason.  Under the excuse “community safety”, they will go overboard and act without regard for the big picture of your life or your community.

It may be impossible to know the mind of a woman.  If you think you might have misunderstood her or that she is lying to police regarding an allegation of Unlawful Sexual Contact or Sexual Assault in Colorado, be smart, exercise your right to remain silent, and call our experienced Sexual Assault lawyers at 303-830-0880.  Together, we can protect your future.
