As it pertains to the news story, one way Sexual Exploitation of a Child can be charged is if someone “possesses with the intent to deal in, sell, or distribute, including but not limited to distributing through digital or electronic means, any sexually exploitative material” (C.R.S. 18-6-403(3)(d)). Since the material the woman allegedly possessed and distributed was of a minor engaged in a sexual performance, it could be considered sexually exploitative material.  A “minor” in Colorado (for the purposes of the Sexual Exploitation of a Child statute) is a person who is less than eighteen years old.
